Can I Keep My Criminal Record Private?

Pretrial Diversion Programs

Texas law allows for individuals facing criminal charges for the first time to enterpretrial diversion programs that ultimately prevent the establishment of a criminal record. Such programs essentially function like probation. The defendant is compelled to take certain actions — perform community service, for example, or enter drug rehabilitation — and stay out of legal trouble for a set period of time.

If an individual completes their program successfully, the criminal charges are dismissed. Likewise, you will be eligible to file for an expunction — that is, the sealing of your criminal record — so that future employers and landlords will be unable to access it.
